What to do if a tenant passes away

At this difficult time we will try our best to make things as simple as possible for you.

What you need to do

  • Give us 28 days’ notice, in writing, to end the tenancy
  • Let us know whether you are the next of kin or the executor of the estate. Or tell us who this is and provide their contact details.
  • Arrange for all belongings to be removed from the property

What you need to know

  • Rent on the property is due until the tenancy is ended
  • Housing benefit (if applicable) ends from the date of death
  • If you are living at the property and do not provide notice to us within 5 working days, we will serve a notice to quit the residence

Can I inherit the tenancy?

Depending on the type of tenancy and your relationship with the tenant who has died, you may be able to take over the tenancy.

What if the tenant needs to leave the property?

If the tenant needs to move out, into a care home for example, we need:

  • 28 days’ notice in writing to end the tenancy
  • If the tenant can’t give notice, a next of kin can do so with the tenant’s signature
  • If the tenant is unable to provide a signature, there must be a power of attorney or legal representative in place to provide notice
